TOBB Economy and Tecchnology University (TOBB ETU) also investigates plagiarism claims about Elif Derya Ubeyli (associate professor). Inan Guler and Elif Derya Ubeyli have publications via Cemal Ardil - Servet Senyucel - Ebru Ardil. Elif Derya Ubeyli has 175+ publication; her recent average is 30 publication per year. Her co-authors : Inan Guler (74+ publication - 4+ with Fatma Nihal Guler, almost all of the rest : no other author), Fatma Nihal Guler (8+ publications), her husband Mustafa Ubeyli (4+ publications). TOBB ETU announces that it has the 1st rank according to publications between all (100+) universities in Turkey. Elif Derya Ubeyli and her husband Mustafa Ubeyli are the publication locomotives of TOBB ETU. Yucel Altunbasak is expected to explain the investigation report about Elif Derya Ubeyli. Ahmet Acar (rector; dean, professor, business administration, Middle East Technical University (METU)) has sent academicians of METU to Cemal Ardil - Ebru Ardil's FAKE CONFERENCES in spite of warning. Ahmet Acar does not want to hear and see anything about plagiarism. Ahmet Acar has violated the communication right of Tansu KUCUKONCU and banned him to communicate with METU Society since Tansu KUCUKONCU warned Ahmet Acar about Cemal Ardil - Ebru Ardil's FAKE CONFERENCES. What makes this more trajedic is that Ahmet Acar's wife Ayse Feride Aybar Acar introduces herself as a specialist on Human Rights. METU "was" the most prestigious university of Turkey and the most world-wide known and having most alumni throughout the world at prestigious institutions and positions, but academicians Kemal Guruz, Aybar Ertepinar, Ismail Tosun, Tugmac Sayrac of METU have made TURKEY A PLAGIARISM PARADISE. Ramazan Aydin (rector, Canakkale Onsekiz / 18 Mart University ; 1999 - 2007 for 8.5 years ; academician, physics, Middle East Technical University (METU)) made Canakkale Onsekiz / 18 Mart University (COMU) a world-wide famous PLAGIARISM PARADISE. Plagiarism in universities of Turkey is not hidden, it is very very obvious; academicians teach their students how to plagiarize (LOTS OF COMPLETELY PLAGIARIZED MSc theses will be available online in this blog). Kemal Guruz, Aybar Ertepinar, Ismail Tosun, Tugmac Sayrac, Ramazan Aydin have punished all who were against their PLAGIARISM PARADISE. Kemal Guruz, Aybar Ertepinar, Ismail Tosun, Tugmac Sayrac, Ramazan Aydin have violated human rights of 10.000s of academicians in Turkey. Aybar Ertepinar said "CEMAL ARDIL and SERVET SENYUCEL's intentions are good, so they should be promoted". Kemal Guruz, Aybar Ertepinar, Ismail Tosun, Tugmac Sayrac, Ramazan Aydin have given extreme harms, which has not been met before, to university system of Turkey and to Turkey and to METU which need 10's of years to recover. Ahmet Acar seems to follow the tradition of Kemal Guruz, Aybar Ertepinar, Ismail Tosun, Tugmac Sayrac. 65 articles of 14 physicists (2 were from METU) have been WITHDRAWN by arXiv in August.2007. Efforts of 4 academicians of METU (physşcs department) has triggered this process. Existance of such academicians is still a very big chance for METU. METU dismissed (job & work) these 2 PhD students (1 was also a teaching assistant). But court canceled their punishments in 2 months, and they returned to METU. Since 1996 courts have approved 10.000s of human rights violations of Kemal Guruz et. al. Yusuf Ziya Ozcan of METU said "good work, so their owners should be promoted" about 65 articles of 14 physicists WITHDRAWN by arXiv in August.2007. Şaibeli YÖK toplantılarının ses kayıtlarını da dinleyen denetçiler, 26.10.2009 tarih ve 2009/33-6 sayılı “Yüksek Öğretimde Devletin Gözetim ve Denetimi / Yasal Çerçeve ve YÖK’ün Uygulamaları” başlıklı ekleri hariç 200 sayfalık rapor hazırladı. -- Cumhurbaşkanlığı Devlet Denetleme Kurulu Denetçileri tarafından hazırlanan 200 sayfalık raporda YÖK eski Başkanları Kemal Gürüz ve Erdoğan Teziç başta olmak üzere YÖK’ün üst kurulları ve Rektörler hakkında çok çarpıcı tespitler yer alıyor. Cumhurbaşkanlığı Genel Sekreteri Mustafa İsen, sözkonusu çalışmayı teyit ederken, Denetçiler tamamladıkları raporlarla ilgili bir dizi suç duyurusunda bulunacak. Suç duyurularının ardından Erdoğan Teziç ve Kemal Gürüz hakkında yargı yolunun açılması ihtimali de gündemde. -- İşte yasadışı yolla saklanan olaylar - YÖK eski Başkanları Prof. Dr. Kemal Gürüz ve Prof. Dr. Erdoğan Teziç hakkında öne sürülen iddialara ilişkin ceza soruşturması yapılmasının, 2547 sayılı Kanunun 53/c maddesine aykırı olarak engellendiği, - YÖK’ün Cumhuriyet Savcılıklarının gönderdiği dosyaları dikkate almadığı, cevap dahi yazmadığı, - Kemal Gürüz ve Erdoğan Teçiz’in, yasalara aykırı olarak, uydurulan “Başkanlık Kararları” ile Rektörleri koruma altına aldığı, - Rektörlerle ilgili olarak, öğretim elemanları veya diğer kişiler tarafından yapılan şikayet başvurularının, bilgi edinme hakları hiçe sayılarak dikkate alınmadığı, - Kamu İhale Kurumu, Maliye Bakanlığı, Sayıştay gibi kurumların incelemelerinin rafa kaldırıldığı, - YÖK eski başkanları, yasalara aykırı olarak, kendileri hakkında yapılan suç duyurularını dikkate almayıp, kendilerini akladığı, - Erdoğan TEZİÇ’in rektörleri özellikle koruduğu, kolladığı ve yargının denetimi dışında bıraktığı, - Görevini kötüye kullanan ve ihale mevzuatına aykırı işlemler yapan Fatih Hilmioğlu hakkında Erdoğan Teziç’in, yasalara aykırı olarak aldığı Başkanlık Kararı ile bu kişinin yargılanmasını engellediği, - Anayasada ve 2547 sayılı Kanunda yapılan değişikliklerin ruhuna uygun olarak, Genelkurmay Başkanlığınca YÖK Denetleme Kuruluna üye seçilmesi uygulamasının sona erdirilmesi gerektiği. -- Kararları yasaların da önünde - DDK raporunda; Rektörlerin haklarındaki pekçok suç duyurusu ve yolsuzluk tespitlerinden dolayı yargılanmamaları için Kemal Gürüz döneminde “Başkanlık Kararları” diye bir uygulamanın “uydurulduğunu” belirtildi. Bu uygulamanın Erdoğan Teziç tarafından da devam ettirildiği ve yasaların hiçe sayılarak Rektörlerin korunduğu belirtildi. -- Suçlarına tek celseli görüşme - Teziç hakkında yapılan ve zaman içinde biriken tüm suç duyurularının, tek bir paket halinde görüşüldüğü 13.06.2006 günkü toplantının ses kayıtları denetçiler tarafından dinlendi. Kayıtlarda, toplantı içeriklerindeki pek çok usulsüzlük ve kanun dışı uygulamalar tespit edildi. Teziç hakkındaki suçlamalar yasa dışı olarak birleştirildi ve aklama gerçekleşti. -- Rektör yolsuzlukları birer birer aklandı - Raporda, Ondokuz Mayıs Üniversitesi Eski Rektörü Ferit Bernay’ın karıştığı yolsuzluk, usulsüzlük ve hatalar neticesinde Cumhuriyet Başsavcılığınca YÖK’e gönderilen dosyanın, Teziç tarafından aklandığı ve Çukurova Üniversitesi Eski Rektörü Yalçın Kekeç’in, üniversitesinde yapılan hukuksuzluğu astlarını korumak için üzerine aldığı, kendisinin de yine aynı yöntemle korunduğu da yer aldı. -- Suçlu görevden alInacak - Raporun ardından denetçiler YÖK Başkanı Yusuf Ziya Özcan’a da gerekli önlemleri alması konusunda bilgi verdi. DDK Denetçileri, Yüksek Öğretim Kurumu (YÖK) başkanlarını suçlayan iddialara karşı alınan kararların hukuka aykırı olduğunu ve sahte imza ile kayda geçirildiğini tespit etti. Disiplin ve Soruşturma Defterleri’nde, imzası olan kişilerin bilgisi haricinde, daha önce farklı evraklara attıkları imzalarının fotokopisi konulmak suretiyle evrakta sahtecilik suçu işlendiği belirlendi. Denetçiler sözkonusu suçun YÖK Genel Sekreterliğinde çalışan bir personel etrafında döndüğünü YÖK Başkanı Özcan’a da bildirdi. Özcan’ın söz konusu kişiyi görevden almaya hazırlandığı öğrenildi. Raporda, bu suçları işleyen YÖK eski başkanları ile haklarında suç duyurusunda bulunulan ilgili dönem rektörlerinin dosyalarının tekrar gündeme alınması tavsiye edildi. YÖK’ün bu tavsiyeye uyacağı öğrenildi. -- Karar defteriyle kayıtlar çelişiyor - Toplantılarda Kanunun açık amir hükmü ortada olduğu halde, Başkanla ilgili suç duyurularının görüşüldüğü toplantılarda Milli Eğitim Bakanının oturuma katılarak başkanlık yapması şartına uyulmadığı da belgelendi. Karar defterindeki kayıtlarla ses kayıtları arasında da çarpıcı çelişkiler bulunduğu tespit edildi. Raporda; “deftere yapıştırılmış diğer kararlar, en başta format itibariyle belli bir şekle göre yazılmışken, 13.06.2006 kararları bu şekle uymamaktadır.” denilerek rapor ve ses kayıtları arasındaki çelişkiler de eklendi. --- Halil Kemal Gürüz - Ergenekon Terör Örgütü (ETÖ) davasında (2008-....) DDK Raporu - 26.10.2009 - sayı : 2009 / 33-6 --- YÜKSEKÖĞRETİM ALANI YOLSUZLUĞUN ÖNLENEMEMESİNE - ARTMASINA ELVERİŞLİ HALE GELMİŞTİR --- DDK, eski YÖK başkanları için soruşturma istedi - Cumhurbaşkanlığı Devlet Denetleme Kurulu, eski YÖK başkanları Kemal Gürüz ve Erdoğan Teziç hakkında soruşturma açılmasını istedi. -- 'Yükseköğretimde Gözetim ve Denetim' raporunu açıklayan Devlet Denetleme Kurulu, yükseköğretimde ciddi bir denetim zafiyeti olduğunu vurguladı. Rapor 'teftiş, inceleme, soruşturma ve diğer idari işlemlerin yapılmasının temini için' Başbakanlığa gönderildi. YÖK'ün ilk defa denetlenmesi anlamına gelen rapor, çok sayıda çarpıcı bilgiyi belgeleriyle ortaya koyarken, geçmiş YÖK yönetimlerinin yaptığı 'hukuksuzluğu' da ortaya koydu. Raporda özetle şöyle denildi : - "Gerek Yükseköğretim Denetleme Kurulu'nun mevcut yapısal sorunları ve denetim uygulamalarındaki eksiklikleri/hataları, gerekse ihbar ve şikâyetler hakkında YÖK Genel Kurulu, YÖK Başkanları ve üniversite rektörlerinin hukuka aykırı uygulamaları Anayasa ile öngörülen denetim olgusunun tamamıyla işlevselliğini yitirmesine yol açmıştır. Bu husus özellikle üniversite ve YÖK yöneticilerinin hesap verilebilirlik ile ilgili algılamalarının değişmesine neden olmuş ve böylece yükseköğretim alanı yolsuzluk ve usulsüzlüğün önlenememesine/artmasına elverişli bir çevre hâline gelmiştir." -- Cumhurbaşkanlığı Devlet Denetleme Kurulu (DDK) raporunda, yükseköğretim alanının yolsuzluk ve usulsüzlüğün artmasına elverişli bir çevre haline geldiği belirtildi. -- Raporun özetinde, YÖK başkanları ve rektörler hakkındaki şikayet ve ihbarlara ilişkin yürütülen iş ve işlemlerin incelendiği belirtildi. Bu çerçevede, YÖK Genel Kurulu ve YÖK başkanları tarafından yürütülen hukuka aykırı uygulamaların ortaya konduğu ve bunlar hakkında soruşturma açılması gerekliliğine işaret edildiği kaydedildi. Raporda, Yükseköğretim Denetleme Kurulu'nun hem mevzuat hem de uygulamaları itibariyle ayrıntılı olarak değerlendirmeye tabi tutulduğu aktarıldı. YÖK'e intikal eden ihbar ve şikayetler hakkında Yükseköğretim Kurulu'nca yürütülen iş ve işlemlerin incelenmesi ve değerlendirilmesinin yapıldığı belirtildi. Yüksek Öğretim Denetleme Kurulu'nun, son 10 yılda gerçekleştirdiği çalışmalar ve ürettiği raporlar üzerinden sayısal incelemeler yapıldığı ifade edilen raporda; şu görüşler aktarıldı : - "Kurulun son 10 yılda gerçekleştirdiği çalışmalar ve ürettiği raporlar üzerinden yapılan sayısal incelemelerle tespit edilen en önemli sonuç; Yükseköğretim Denetleme Kurulu'nun devlet üniversiteleri üzerindeki gözetim ve denetim anlamındaki asli fonksiyonundan neredeyse bütünüyle çekilmiş olmasıdır. Son 10 yılda bu alanda yapılmış tüm görevlendirmeler, 2006 yılında Kurula verilen 3 üniversite (Çanakkale Onsekiz Mart Üniversitesi, Balıkesir Üniversitesi ve Boğaziçi Üniversitesi) ile ilgili genel denetim görevinden ibarettir. Buna karşılık, Kurul genel denetim çalışmalarını bütünüyle vakıf üniversitelerine yönlendirmiş görünmektedir. 2000-2008 yılları arasında toplam 223 genel denetim raporu düzenlenmiş olup, bu raporlardan sadece üçü devlet üniversitelerinden icra edilen denetimlere, diğerleri ise vakıf üniversitelerine yöneliktir." Raporda, Yükseköğretim Denetleme Kurulu'nun hem nicelik hem de nitelik açısından denetim işlevine odaklı olarak kurulmadığı kaydedilerek, "Kurulun mevcut oluşumu ve üye sayısı, hem nicelik hem de nitelik açısından, tüm Türk Yükseköğretim Sisteminin denetlenmesi görevini yerine getirmeye yetecek kapasitede olmaktan uzaktır." denildi. -- İHBAR VE ŞİKAYETLER - Raporda, gelen ihbar ve şikayetler üzerinde de duruldu. 'Yükseköğretim Denetleme Kurulu'nca yazılan raporlarda, soruşturma açılması istenen az sayıdaki durumlarda dahi raporda varılan sonucu değiştirecek nitelikte herhangi bir kanıt bulunmaksızın hukuka aykırı bir biçimde YÖK Başkanınca soruşturma açılmasına gerek olmadığına dair karar verildiği belirtildi. "Muhbir ve şikayetçinin kimliği gizlenmeksizin, ihbar ve şikayet konusu iddiaların idari araştırma kapsamında haklarında ihbar ve şikayette bulunulan kişilere-rektöre-üniversitelere gönderilmesi suretiyle muhbir ve şikayetçilerin kimlik bilgilerinin ifşa edilmesi biçiminde hukuka aykırı işlemler yapıldığı tespit edilmiştir." ifadelerine yer verildi. -- "YÜKSEKÖĞRETİM ALANI YOLSUZLUĞUN ÖNLENEMEMESİNE ELVERİŞLİ HALE GELDİ" - Raporun sonuç bölümünde, devletin üniversiteler üzerindeki gözetim ve denetiminin, gerek mevzuat alt yapısındaki eksiklikler, gerekse YÖK Genel Kurulu, YÖK başkanları ve Yükseköğretim Denetleme Kurulu'nun uygulamaları nedeniyle, devlet adına icra edilen bir kamu hizmeti olma niteliğini tamamıyla kaybettiği kaydedildi. Yükseköğretim Denetleme Kurulu'nun 'mevcut yapısal sorunları ve denetim uygulamalarındaki eksiklikleri/hataları gerekse ihbar ve şikayetler hakkında YÖK Genel Kurulu, YÖK başkanları ve üniversite rektörlerinin hukuka aykırı uygulamalarının Anayasa ile öngörülen denetim olgusunun tamamıyla işlevselliğini yitirmesine yol açtığı' ifade edildi. Raporda, "Bu husus, özellikle yükseköğretim kurum ve üst kuruluşlarının yöneticilerinin hesap verilebilirlik ile ilgili algılamalarının değişmesine neden olmuş ve böylece yükseköğretim alanı yolsuzluk ve usulsüzlüğün önlenememesine/artmasına elverişli bir çevre haline gelmiştir. Cumhurbaşkanlığı Devlet Denetleme Kurulu “Yükseköğretimde Gözetim ve Denetim” raporunu açıkladı. Raporda, yüksek öğretim alanının 'denetim açığı' nedeniyle 'yolsuzluk ve usulsüzlüğe elverişli bir çevre' hâline geldiği ve bu durumun kronikleştiği tespiti yapıldı. -- DENETİM AÇIĞI KRONİKLEŞTİ - Rapora göre YÖK'ün kontrolündeki Yükseköğretim Denetleme Kurulu, YÖK Başkanları ve rektörler hakkındaki ihbar ve şikayetler ile ilgili "soruşturma açılmasına gerek görülmemiştir" kararları vererek "hukuka aykırı" davrandı. Üniversitelerde denetim açığının kronik hale geldiğini belirten DDK, eski YÖK Başkanlarının ve Yükseköğretim Denetleme Kurulu'nun "hukuka aykırı" uygulamaları nedeniyle soruşturma açılmasını istedi. -- İLK DEFA DENETLENDİ - YÖK'ün ilk defa denetlenmesi anlamına gelen rapor, çok sayıda çarpıcı bilgiyi belgeleriyle ortaya koyarken, geçmiş YÖK yönetimlerinin yaptığı 'hukuksuzluğu' da ortaya koydu. İşte DDK raporunun ortaya çıkardığı çarpıcı gerçekler : -İhbar ve şikâyetlerle ilgili olarak "soruşturma açılmasına gerek yoktur" şeklinde kararlar alınarak herhangi bir soruşturma yapılmadı. -'Soruşturma açılmasına gerek görülmemiştir' şeklinde alınan kararlar cari bir usul hâline getirildi ve ihbar ve şikâyet müessesesinin işlerliğini kaybetmesine yol açıldı. -Hesap verilebilirlikten uzak bir çalışma yöntemi, her seviyede YÖK'e hakim oldu. Böylece çeşitli sahtecilik fiilleri bu ortamda vücut buldu. -Sayıştay, Maliye Bakanlığı veya Cumhuriyet Savcılıklarının yazıları şikâyet edilen üniversite rektörüne gönderildi. Rektörün cevabi yazısı esas alınarak "soruşturmaya mahal bulunmadığı" şeklinde Başkanlık kararları alındı. -- ŞİKAYETÇİLER İHBAR EDİLDİ - Raporda, muhbir ve şikâyetçinin kimliklerinin gizlenmeksizin, ihbar ve şikayetin, şikâyette bulunulan kişilere/rektörlere/üniversitelere gönderilerek, muhbir ve şikâyetçilerin kimlik bilgilerinin 'hukuka aykırı bir şekilde' ifşa edildiği tespiti yapıldı. Ayrıca alınan "soruşturma açılmamasına yönelik" kararların, muhbir ve müştekiler ile Cumhuriyet Savcılıklarına gönderilmeyerek dava açma hakkının ortadan kaldırıldığı belirlendi. DDK Raporu'nda, Yükseköğretim Denetleme Kurulunun yeni baştan ele alınarak soruşturmaların, 2547 sayılı Kanunun 53/c maddesine göre değil, genel hükümlere göre yapılması önerisi de getirdi. -- Şikayet mekanizması yanlış, değiştireceğiz - YÖK Başkanı Yusuf Ziya Özcan, gazetecilerin, Devlet Denetleme Kurulu'nun (DDK) yükseköğretimle ilgili raporu ile ilgili sorularını cevapladı. Bir gazetecinin 'Rektörlerle ilgili şikayette bulunan kişilerin muhbirlerin isimlerinin ifşa edilmesi de eleştiriliyor bununla ilgili bir değerlendirmeniz olacak mı?' sorusunu Özcan, 'Zaten rektörden şikayeti olan adamı, biz tekrar rektöre yolluyorduk. O yanlış bir şey. Ben size bunu birkaç kere söyledim. Onu değiştirmemiz lazım. Siz rektörü şikayet ediyorsunuz, biz de alıyoruz diyoruz ki; 'Bu şahıs şikayet ediyor, şuna bir bakın'. DDK Denetçileri, Yüksek Öğretim Kurumu (YÖK) başkanlarını suçlayan iddialara karşı alınan kararların hukuka aykırı olduğunu ve sahte imza ile kayda geçirildiğini tespit etti. Disiplin ve Soruşturma Defterleri’nde, imzası olan kişilerin bilgisi haricinde, daha önce farklı evraklara attıkları imzalarının fotokopisi konulmak suretiyle evrakta sahtecilik suçu işlendiği belirlendi. Denetçiler sözkonusu suçun YÖK Genel Sekreterliğinde çalışan bir personel etrafında döndüğünü YÖK Başkanı Özcan’a da bildirdi. Özcan’ın söz konusu kişiyi görevden almaya hazırlandığı öğrenildi. Raporda, bu suçları işleyen YÖK eski başkanları ile haklarında suç duyurusunda bulunulan ilgili dönem rektörlerinin dosyalarının tekrar gündeme alınması tavsiye edildi. YÖK’ün bu tavsiyeye uyacağı öğrenildi. -- Karar defteriyle kayıtlar çelişiyor - Toplantılarda Kanunun açık amir hükmü ortada olduğu halde, Başkanla ilgili suç duyurularının görüşüldüğü toplantılarda Milli Eğitim Bakanının oturuma katılarak başkanlık yapması şartına uyulmadığı da belgelendi. Karar defterindeki kayıtlarla ses kayıtları arasında da çarpıcı çelişkiler bulunduğu tespit edildi. Raporda; “deftere yapıştırılmış diğer kararlar, en başta format itibariyle belli bir şekle göre yazılmışken, 13.06.2006 kararları bu şekle uymamaktadır.” denilerek rapor ve ses kayıtları arasındaki çelişkiler de eklendi. --- Halil Kemal Gürüz - Ergenekon Terör Örgütü (ETÖ) davasında (2008-....) Rapor 'teftiş, inceleme, soruşturma ve diğer idari işlemlerin yapılmasının temini için' Başbakanlığa gönderildi. YÖK'ün ilk defa denetlenmesi anlamına gelen rapor, çok sayıda çarpıcı bilgiyi belgeleriyle ortaya koyarken, geçmiş YÖK yönetimlerinin yaptığı 'hukuksuzluğu' da ortaya koydu. Raporda özetle şöyle denildi : - "Gerek Yükseköğretim Denetleme Kurulu'nun mevcut yapısal sorunları ve denetim uygulamalarındaki eksiklikleri/hataları, gerekse ihbar ve şikâyetler hakkında YÖK Genel Kurulu, YÖK Başkanları ve üniversite rektörlerinin hukuka aykırı uygulamaları Anayasa ile öngörülen denetim olgusunun tamamıyla işlevselliğini yitirmesine yol açmıştır. Bu husus özellikle üniversite ve YÖK yöneticilerinin hesap verilebilirlik ile ilgili algılamalarının değişmesine neden olmuş ve böylece yükseköğretim alanı yolsuzluk ve usulsüzlüğün önlenememesine/artmasına elverişli bir çevre hâline gelmiştir." -- Cumhurbaşkanlığı Devlet Denetleme Kurulu (DDK) raporunda, yükseköğretim alanının yolsuzluk ve usulsüzlüğün artmasına elverişli bir çevre haline geldiği belirtildi. -- "YÜKSEKÖĞRETİM ALANI YOLSUZLUĞUN ÖNLENEMEMESİNE ELVERİŞLİ HALE GELDİ" - Raporun sonuç bölümünde, devletin üniversiteler üzerindeki gözetim ve denetiminin, gerek mevzuat alt yapısındaki eksiklikler, gerekse YÖK Genel Kurulu, YÖK başkanları ve Yükseköğretim Denetleme Kurulu'nun uygulamaları nedeniyle, devlet adına icra edilen bir kamu hizmeti olma niteliğini tamamıyla kaybettiği kaydedildi.
